Acceptable Use Policy
Thank you for your interest in the LeadNetwork.com website (the "Website"). The Website is the internet property of LeadNetwork.com. This Acceptable Use Policy ("AUP") explains the correct kind of conduct and prohibited use of LeadNetwork.com’s services (the "Services"), as subscribed to and described in pursuant to this applicable agreement which is executed by you and is between you and LeadNetwork.com (the "Agreement") to which this policy is incorporated. Where any of the terms of this AUP come into conflict with any terms contained in another contract, this Agreement shall govern in all respects. This AUP is not exhaustive and we at LeadNetwork.com reserve the right, at any time, to modify this AUP, which will become effective upon the posting of the modified version AUP to the Website. By you registering for and using the publisher network and publisher services provided by LeadNetwork.com (collectively the "Services"), and therefore by you accepting all terms and conditions of this applicable Agreement, you do agree to abide by this AUP as it is modified from time to time. Any violation of this AUP could result in the termination or suspension of your Services account and any such other action as LeadNetwork.com deems to be appropriate. You retain sole liability and responsibility for your use of the Services and all and any content you display, transmit, download or upload via the use of the Services.
We use all of this information to process requests for services and products. We also use and information collected to communicate with you, for example to notify you (through e-mails and newsletters) of updates to products, send you order confirmations and/or to provide you with important product safety or warranty information.
In addition, we use personal information you provide, other than your Sensitive Information, to respond to your inquiries about our offers, and to offer you, by means of e-mail or through our newsletter, additional services, products or programs we believe may be of interest to you.
Defamation. You hereby agree not to transmit or post any content that violates any applicable libel or defamation laws in the US or elsewhere.
False advertising. You hereby agree not to transmit or post on or via any Publisher Website and/or Publisher Databases promotional or advertising material that contains deceptive, false, or misleading statements, representations or claims. This includes, but is not limited to "job sites" which deceive consumers with promises of employment if they complete an offer such as a business or education opportunity.
Social network/job listing site compliance. You hereby agree not to transmit or post content that will be considered as deceptive in chat rooms, public message boards, or in public pages of social network and job sites including but not limited to Facebook, Craig's List, etc.
Copyright/trademark infringement. You hereby agree not to transmit or post on or via any Publisher Website and/or Publisher Databases content that infringes intellectual property rights or other proprietary rights including but not limited to material protected by patent, copyright, trade secret, trademark, or other intellectual property rights of another entity or person or use it without correct authorization. Infringement can result from, among other things, the unauthorized posting or copying of logos, pictures, articles, software, music and videos.
Offensive materials. You hereby agree not to sell, transmit, store, disseminate, or host material that is defamatory, unlawful, obscene, libelous, pornographic, lewd, indecent, threatening, harassing, invasive or harmful of publicity or privacy rights, inflammatory, abusive or otherwise objectionable.
Export violations. You hereby agree not to send or post technical information or software in violation of US export laws including but not limited to the Export Administration Regulations and the Export Administration Act maintained by the Department of Commerce.
Harmful content. You hereby agree not to host or disseminate harmful content including but not limited to worms, viruses, time bombs, Trojan horses, spyware, cancelbots, adware or any other programming routines and/or computer software that may interfere with, damage, surreptitiously intercept or expropriate any program, system, data or personal information.
Fraudulent conduct. You hereby agree not to disseminate or offer fraudulent services, goods, promotions or schemes (chain letters, make money fast schemes, pyramid schemes), provide false data on any signup form, online application, contract or registration, or fraudulently use information obtained via the use of the Services including but not limited to use of credit card numbers.
False pretenses. You hereby agree not to use the Services to communicate under a false name or impersonate any person or use a name you are not authorized or entitled to use in any form of online communication. False domain registration is strictly prohibited.
Failure to abide with third-party website policies. You hereby agree not to violate the regulations, rules or policies that apply to any server computer database, third-party network or website you access or use by or via the Services.
Child pornography. You hereby agree not to violate any federal or state child exploitation statutes to produce, possess, receive, distribute or transport by any means, including via computer, visual depictions of "sexually explicit conduct" involving children.
Facilitating a violation of this AUP. You hereby agree not to transmit, advertise or otherwise make available any program, software, service or product designed to violate this AUP including but not limited to, pinging, spam, mail-bombing, flooding, piracy of software or denial of service attacks.
Unauthorized access. You hereby agree not to use the Services to attempt to access, or to access, the accounts of others or to attempt to penetrate, or penetrate, another entity’s security measures, computer hardware or software, telecommunications or electronic communications system, whether or not the intrusion results in corruption of data or data loss.
Collection of personal data. You hereby agree not to use the Services to attempt to collect, or collect, personal information from third parties without their prior knowledge and express consent.
Reselling the services. You hereby agree not to resell the Services without the prior express consent (written) of LeadNetwork.com.
Network disruptions and unfriendly activity. You hereby agree not to use the Services for any activity that could adversely affect the ability of systems or other people to use the Services or the internet. This includes "denial of service" (DoS) attacks against another individual user or network host. Interference with or disruption of other Service network, Service users or Service network equipment is prohibited. It is your sole responsibility to ensure your network and/or Publisher Website is/are configured in a manner that is secure. You may not, either via action or inaction, permit others to use your network and/or Publisher Website for inappropriate or illegal purposes. You may not allow your network and/or Publisher Website, either via action or inaction, to be configured in a way that can give a third party the capability to use such network and/or Publisher Website in an inappropriate or illegal manner.
Confidential information. You hereby agree not to display any street addresses, telephone numbers, last names, URLs, email addresses or personal information, text, audio files, videos, photographs, or other images containing confidential information of any third party on any Publisher Website and/or Publisher Database.
Harassment. You hereby agree not to "stalk" or otherwise harass any person through the Services, the Publisher Website and/or the Publisher Databases.
Endorsement. You hereby agree not to imply or express any statements you make are endorsed by LeadNetwork.com, without the prior express consent (written) of LeadNetwork.com.
Circumvention. You hereby agree not to use any spider, robot, site search/retrieval application, or other automatic or manual device, or process to index, retrieve, "data mine," or any other method to circumvent or reproduce the presentation or navigational structure of the Services or related content.
Framing. You hereby agree not to “mirror” or “frame” any part of the Services and/or LeadNetwork.com or Advertiser Website, without the prior express consent (written) of LeadNetwork.com.
Redirects. You hereby agree not to use code, metatags or other devices containing any reference to LeadNetwork.com, the Services and/or any Advertiser to direct a person to any other website for any purpose.
Reverse engineer. You hereby agree not to adapt, modify, translate, sublicense, sell, decipher, reverse engineer, decompile or disassemble any portion of the Services or any software used on/for the Services.
Hacking. Unauthorized access to or use of systems, data, networks or servers, including any attempt to scan, probe or test the vulnerability of a system, network or server to breach authentication or security measures without the express authorization of the owner of the server, system, or network.
Interception. Unauthorized monitoring of traffic or data on any system, network or server without the express authorization of the owner of the server, system or network.
Intentional interference. Interference with the service to any host, user, or network including but not limited to mail-bombing, broadcast attacks, news-bombing, any other flooding techniques, attempts to overload a system deliberately and any activity resulting in a host crashing. Intentional interference also means the utilization of any type of script/program/command, or the sending of any kind of messages that are designed to interfere with the terminal session of the user, via any means, locally or the Internet.
Falsification of routing or origin information. The forging of any email header, TCP-IP packet header or any part of a message header. Selling, using, or distributing in combination with the Services, or otherwise, any program that is designed to conceal the routing information or the source of email messages in a way that falsifies header information, an internet domain, date/time stamp, originating email address or any other identifier.
Avoiding system restrictions. Using electronic or manual means to avoid use limitations placed on the Services, for example timing out.
Failure in safeguarding accounts. Failing to prevent access to accounts that is unauthorized, including any account passwords.
Unsolicited promotions, solicitations or advertising (commonly known as "spam") that does not comply with CAN-SPAM including but not limited to informational announcements and commercial advertising to those email addresses which have requested their email addresses be opted out.
Advertising, commercial promotions, informational announcements or solicitations that contain misleading or false information in any form.
Harassing email, whether through frequency, language, size of messages or any other element.
Chain letters.
Malicious email including but not limited to "mail-bombing" or "trolling".
Emails containing falsified or forged information in the header (including routing information and sender name), or any other falsified of forged information.
Emails containing links to a third party. A third party website should not be inserted in emails without the direct or indirect permission of that party, your email should also conspicuously notify a recipient the link is to a third party you do not control or operate.
In addition, you may not use LeadNetwork.com's mail server or the mail server of another website to relay mail without prior express permission (written) of the account holder or the website operator. Posting the same/similar message to one or more message boards, newsgroups, blogs, the LeadNetwork.com discussion groups, is considered excessive multiple/cross-posting and is also explicitly prohibited.
We use the non-personally identifiable information we collect to improve the content and design of our website pages and to allow us to personalize the internet experience for you. We may also aggregate information to analyze website usage.
1. Your general responsibilities
As a Publisher (as the term is defined in the Agreement), the Services give you the ability to access offers and creatives from LeadNetwork.com and its’ Advertisers (as the term is defined in the Agreement) you can market through and by: 1. A website you own, operate and/or control ("Publisher Website"); and/or 2. Email messages sent to databases you own, operate and/or control ("Publisher Databases"). Generally, LeadNetwork.com does not actively censor, monitor, or directly control any content that is or will be displayed on your Publisher Website, transmitted to your Publisher Databases, or any information you collect or use via your Publisher Website and/or Publisher Databases. However, LeadNetwork.com provides the Services with the following goals: (a) ensuring reliability, security, and privacy of the Services and users of the Services; (b) maintaining a reputation and image of LeadNetwork.com as the responsible provider of the Services; (c) preserving the internet resources value as a form for free expression; and (d) encouraging responsible use of internet resources and discouraging illegal, degrading or libelous uses of such resources. As a consequence, LeadNetwork.com has the expectation you, and all other users of the Services, take responsibility for using the internet with responsibility and courtesy, and to be familiar with and to practice good internet etiquette, pursuant to the above stated goals.We use all of this information to process requests for services and products. 2. Prohibited conduct

The following list is non-exhaustive but details the types of harmful or illegal conduct that is prohibited. LeadNetwork.com reserves the right to prohibit or restrict any and all use of the content or Services on your Publisher Website and/or your Publisher Databases, and remove any materials from its servers, where LeadNetwork.com determines at its sole discretion such content and/or use harms its servers, network, systems, good will, reputation, LeadNetwork.com itself and any other customers of LeadNetwork.com or any third party.Defamation. 3. System and network security and integrity
Violations of LeadNetwork.com's or any third party's system, server, or network security via the use of the Services are strictly prohibited, and may result in civil and /or criminal liability. LeadNetwork.com may, but is not obligated to, investigate any incidents involving such violations and may involve and subsequently cooperate with law enforcement authorities if criminal violation is suspected. Examples of violations of system, server or network security include but are not limited to the following:Hacking. 4. Email
The Services may be utilized for the transmission of unsolicited commercial email to Publisher Databases only in compliance with all US federal and state laws including but not limited to the CAN-SPAM Act 2003, as amended from time to time, as well as any and all Federal Trade Commission regulations ("CAN-SPAM"). 5. Instant messaging and chat services
Inappropriate use or misuse of chat/instant messaging applications on the LeadNetwork.com network or elsewhere in connection with the Services is strictly prohibited. Examples include but are not limited to sending instant messages containing abusive, threatening, libelous or illegal material.
